Criminological Theory Essay

Criminological theories are logical facts, which help us in understanding and analyzing crime and their causes. Such theories are formed using statistics, case histories, official records and sociological field methods on criminals and their activities. Criminological theories are mainly focused on crime and its causes. Many psycho criminologists had attributed crimes to personality disorders, psychopaths, sociopaths, and antisocial personalities. Emotional disorders are generally considered as cause for crime, which are mostly rooted in childhood experiences where the criminal attempts a suppressed wish or desire. These theories basically correlate crimes to the psyche of the offender, explains the causes and situation that motivates the offender. All theories have to some extent, a set of assumptions like human behavior under economic and social setups, elements of causation, etc. , based on which facts are interpreted and explained A person takes to crime basically to satisfy his or her demands at that point of time. These demands may be vary from material requirements like money, expensive items or even sustenance and lust. The demands on a person normally depend on the environment they are brought up. It has been widely believed that poverty and slum are the breeding ground for criminals. Thus people from slums would take to criminal activities like robbery and murder to make a living and sustain themselves. This does not mean that they would refrain from crime once they get what they need. As needs are always on a recurring basis, they always have their needs to be met. Seeing the easy way of life, they hang on to it, even offering their criminal services for money. Though they may not be in slums anymore now, they graduate to being professional criminals. Similarly crimes like drunken driving, drug abuse and sexual assaults are more associated with youth because the compulsion to seek them is more among the youth. The urge to seek adventure, try new things and the need for sex are very prominent among the youth. Crimes involving businessmen is more associated with economic and property offenses, forgery etc. Although the methods adopted in execution of their crimes may differ, the intention of all criminals is to get what they seek. Though personal requirements and unavailability to get them legally drive people to commit crime, the hesitance or encouragement to commit crime varies widely. These are more dependent on one’s heredity and body dysfunction. A person’s decision to take to crime or refrain from it, the extent and nature of the crime to be committed depends on their heredity, hormone functioning and neuropsychological disorders. Thus we see mentally affected people turning out to be psychopath killers, killing people mercilessly for no reason. Also the reason why people take to crime is significantly different between men and women. Gender plays an important role in the need and nature of crime committed. Men and women have differing offence rates and offence patterns, both as offenders and as victims. The opportunities and capabilities of men and women for crime are different, which is reflected in their crime pattern. This crime committed for needs satisfaction may be analyzed by determining the needs of the criminal who had committed it. By correlating the crime committed, the risks taken and the gains sought; would reflect how badly the criminal required it. These factors in turn would throw up other details to profile the criminal. However it should be emphasized here that it is not possible for any single theory to fully and perfectly explain every crime or deviant act. A good explanation of the crime can only be got by incorporating various theories. It is unfortunate that criminological theories are never completely supported or refuted. While some empirical tests may support the theory; some might offer partial support while the others might refute the theory. Theories are therefore evaluated based on their ‘weight of evidence’, as to whether a majority of tests support or reject the theory. Crime theories are generally not directly specific to crime causation, but helps to understand crime in a bigger perspective, by being more specific on behavior.

The Glorification and Horrors of War Through the Arts

Artistes have always painted scenes of war from the Ancient worlds of Egypt and Greece. The relief inside the Abu Simbel Temple showing Ramses in the Battle of Kadesh and of his victory over the Hittites is an excellent example. The Athena Frieze depicting the battle of Greeks against the Persians, which are some of the earliest example of a specific historical event being, sculptured (Greek Art). To the photographs that are coming from the current war in Iraq and Afghanistan, the flagged draped coffins of the dead in the cargo hull on their way home. In the periods of art, before Goya’s the Third of May tended to glorify war and make it seem romantic and heroic without the effects of the bloodshed and horrors that war brings. Benjamin West’s The Death of General Wolfe does show the effect of war, however, he has made a martyr of General Wolfe surrounded by his officers making this painting seems to be Romanizing the death (Class Lecture-The Neoclassical 2 of 3). Benjamin West was an American Neoclassical painter who turned art historical order upside down by not depicting a classical theme and used clothing of the time (Gehmacaher). The Neoclassical period of art was a reaction to the Baroque and Rococo style of art where a renewed interest for classical antiquity of the ancient Greek and Roman seeking the geometric harmony of the time (Kleiner 330). The Neoclassical period of art was during the Enlightenment period where critical thinking of the world and humankind spurred the great political, social and economic changes resulted in Revolutions in France and America (Kleiner 319). Writers such as Rousseau, Voltaire, and Jefferson help the change the critical thinking in political, social and economic toward humankind and what was going on in the world helped inspired the French and American Revolutions (Class Lecture-The Neoclassical 1 of 3). This influenced the people to put a new light on all thinking and question the traditional ideas and ways of doing things whether it was in painting, sculpture, writing, science, politics, and nature (Smart History). The Death of General Wolfe is the final stages of the Battle of the Plains of Abraham, which takes place in Quebec, Canada, when the French and British fought during the Seven Year’s War for control of Canada or as it was called then New France (Gehmacher). General Wolfe, a British officer, won the battle but lost his life in this campaign on September 13, 1759, the French surrendered Quebec five days later and by 1760 surrendered in Montreal after a failed attempt to regain control of the capital (BBC). West has distorted the events surrounding General Wolfe death to heighten the drama in this painting (Gehmacher). West does not depict General Wolfe in armor like that of ancient soldiers but he has paid close attention to the details of the uniforms and the clothes of the Indians (Stacey). To me, West has made a martyr of General Wolfe by having him surrounded by his officers and Indians with the front lines not far off. This also glorifies and romanizes war, everyone around the dying General seem unaffected by the battle that is raging nearby. Jacques-Louis David preferred the ancient and Renaissance works, and agreed with the Enlightenment philosophy that the subject matter should have a moral balance reflect the artwork of ancient times and depicting noble events in history would civil virtues and patriotism (Kleiner 332) inspire. David’s Oath of the Horatii is an excellent example of the Enlightenment philosophy and of Neoclassical style. David became the painter of French Revolution and was on the board that voted to behead the King; he also became the official painter for Napoleon (Zucker). Oath of the Horatii is keeping with the neoclassical style, by the David has used colors and by classicizing contemporary subject matter (Gersh-Nesic). David has used diagonal movements with heroic poses of the father and sons, and grouping the women behind the focus of the painting to give this painting the classic feel, that it has (The Neoclassical 3 of 3). Oath of the Horatii is about three brothers swearing on oath on their swords with their father gives them, the sons swear to fight to the death for their country (Zucker). David has a group of women that seem in despair over the oath of the brothers, he has also bathed the women in light to show their despair. David has used the dark archways to give depth to this painting and light on the swords and arms of the brothers to show their bond with their father. The one thing I have noticed about David style of painting is that has fluidness about his work and there are no brush strokes visible. David’s male figures appear statuesque and virile like the ancient Greek and Roman soldiers; he has also used soft colors to make this painting more alluring and dramatic. This painting like that of West seems to glorify the act of war. These painting are done in the Neoclassical style but they both have a different feel to them. West’s has the act of dying on the battlefield and has used the clothing of the times and no reference to the past. David on the other hand has depicted an ancient Roman scene. To me this is the last art period that depicts war as heroic and glorifies it. The Romantics were about getting back to nature and the common people to evoke individualism, subjectivism, imagination and emotions (Romanticism). The Romantics were the first group of artists to turn away from the academic style of the Neoclassical, this movement started in the late 18th century and early 19th century because of the Napoleonic wars (Romanticism). The transition from Neoclassicism was a shift from reason to feeling and uses the social and political climate to draw their inspiration (Kleiner 340). Goya, a Spanish Romantic artist, Third of May is an example of the radical shifts from the Neoclassicism. Here Goya has used light and dark to emphasis the scene that is unfolding before us. The Spanish King, Charles IV, asked Napoleon to help Spain defend them against Great Britain, Napoleon saw this as a weakness and took control of Spain by putting his brother in control of Spain (Zucker). The Spanish who first liked the idea of the French getting rid of the British, the Spanish people soon realized the French as invaders and on the 2nd of May, the Spanish attacked Napoleon’s men in a violent clash (Kleiner 341). Napoleon’s men then responded by executing several Spanish citizens, Goya is painting that massacre. The Third of May is the result and Goya has done an excellent job here is showing the senseless act by the French soldiers. Goya has used the light on the man in the front with his arms outreached about to be executed to draw your attention to the brutal act of the soldiers and to evoke empathy to common man. Goya has the French soldiers back to the viewer so they cannot see their face to show the injustice unfolding. He has used the mountain or hill in the background to show the people as trapped and no way to get away from the soldiers and dead bodies around to show how helpless these people are (Zucker). Goya has used several things to draw attention to what is going on in this painting, the rifles pointing at the man in the white shirt on his knees, the blood in on the ground in front of him, the lantern to shed light on the man about to be shot and his face that shows no fear. All of this helps show the ruthlessness of the French soldiers. He has also used earth tones in this painting with strong brushstrokes and used shadows that show the Romantic styles break from the Neoclassical style. While I find this painting, somewhat disturbing Goya has used his coloring, shadowing, and lines to draw to viewer into this painting and feel the helplessness of the Spanish people and Goya has made a martyr of the man about to be shot. Realism was a moment the developed out of the Industrial Revolution when artist in France rejected the fantastic and focused on the reality of the world and painted the everyday life (Photography and Realism 4 of 6). Painters like Gustave Courbet and Jean-Francois Millet painted wonderful scenes of the everyday peasant life in The Stone Breakers and The Gleaners but it was during this time that photography came into the world and could capture life and preserve that moment forever. Timothy O’Sullivan’s photography A Harvest of Death, Gettysburg, Pennsylvania shows the true horrors of war; this was taken after one of the worst battles during the American Civil War. The Civil War was due to the Industrial Revolution effects of the northern states becoming more industrial than the south that was still an agricultural society that was using slaves for the work. In this photograph, there is a fog over the battlefield in the distance you can see men on horses, as you look closer at the dead soldiers you can see that the Confederate soldiers’ shoes have been removed. The shoes of the dead were removed for use of surviving soldiers who needed them and it did not stop at the shoes for once again the Confederate soldiers’ pockets have been gone through for their pockets appear turned out (Cornell University). This photography shows the true reality of the horrors of war in the awful details this photography has taken. Photographs of other wars also show the horrible reality of war, and the power of the picture speaks for the horrors of war. The photos of the oncentrations camps after World War II are excellent examples of man’s inhumanity to man, and I will not describe any of these here because to are too horrific to look at. The photograph of the flag being raised on Iwo Jima shows six men raising an American flag after a battle for the island. This picture is showing a simple act of raising the flag to show their support for their country. While this photo does not show the horrors of war, it shows that despite the battle that fough t and the loss of life there can be a simple act that defines us. Then there is the photograph of the aftermath of a napalm attack in Vietnam taken by Nick Ut, here you see Vietnamese children running through the streets screaming and one little girl has no clothes on, soldiers are behind the children and in the background you can see the smoke of the bombs. Photographer Ut said that he had seen two airplanes and each one dropped four bombs and minutes later he saw the people running away and the little girl that appears to be the focus of the image yelling for water because she was to hot (BBC News). The terrified face of the children screaming speaks volumes in this photo and shows how war affects everyone not just the soldiers fighting the battles. Photographs show the reality of war in unflinching view, while painters interrupt what they see. The German Expressionists did just that after World War I. German Expressionists used disorganized outlines and angry brushstrokes to connive their message in their works and to illustrate the injustice of society that was growing during this time of global uncertainty (German Expressionism). There were several movements in the German Expressionist; the first was called Der Brucke (The Bridge), Der Blaue Reiter (The Blue Rider) and Neue Sachlickeit (New Objectivity). Franz Marc was one of the founders of the Der Blaue Reiter, which got its name from Marc and Vassily Kandinsky’s interest in horses and the color blue (Kleiner 386). However, Marc did not paint Fate of the Animals during World War I, but while serving during the war he wrote a letter to his wife that â€Å"is like a premonition of this war—horrible and shattering. I can hardly conceive that I painted it† (Kleiner 388). Here Marc is showing us a forest that is being destroyed uses vivid colors and jagged forms to connive his message (Labedzki). I have used this painting because I think had Marc lived through World War I, he would have painted another form of this to show the horrors he saw during that time. He said to his wife that this was a premonition; I can only image what he would have painted after the war. Wilhelm Heinrich Otto Dix, known for his work under the name Otto Dix, was a German Expressionists in the Neue Sachlichkeit (New Objectivity). This movement formed after World War I by artist that severed in the German army and their experiences military influenced their art (Kleiner 400). Otto Dix’s aim was to show the world those experiences with wrenching, ruthless and harsh depictions of the war as depicted in his Shock Troops Advance under Gas and The Trench (Henshaw). The Trench is filled dead bodies at different stages of decomposition did cause a public outcry that the museum director show the painting was forced to resign (WWI, Otto Dix). Dix said of his work â€Å"that life is not colorful at all. It is much darker, quieter in its tonality, much simpler. I wanted to depict things as they really are† (Heller). Dix depicted the war as it actually was and drew great criticism for his works with the war as the subject. Dix’s medium for Shock Troops Advance under Gas was an etching, portraying the soldiers need to wear gas masks due to the invention of mustard gas used in World War I. Once again showing man’s inhumanity to man. This reminds me of Munch’s Scream.

Never the less, inclusion gives equitable education and training opportunities for all young people. This help to prepare all young people to a productive life ahead. Therefore, those who have various disabilities can be able to live th eir lives to the fullest (Wilkinson and Ahmed 2007). Special Education Needs (SEP) are the principles that govern sustainable inclusion, and outline several practices that various shareholders are required to do to ensure that the project succeed. Norwich 2008 argues that, if inclusion is to be successful, early intervention and involvement of children is required. Many parents don’t give their children time to develop among their peers. Schools do not have special facilities to cater for the needs of these children. The situation is reversed when her husband Brently Mallard walks in as if nothing had happened. He had not even heard of the railroad disaster in which he was assumed to have been killed. Since the story opens with a statement that ‘Mrs Mallard was afflicted with a heart trouble’ it is logically acceptable that she dies in the end of ‘heart disease’ on seeing her husband’s unexpected return. However, the dramatic irony is when the doctors conclude that she died of joy at seeing her husband, when the reader knows that it is more likely to be the opposite. She is denied the freedom she enjoyed momentarily, when she believed that she was to be free of her domestic duties and responsibilities to a husband who expected her subservience implicitly. The story also has instances of verbal irony. Even the very first sentence partly quoted in the above paragraph contains the indefinite article ‘a’ before heart trouble. It is a vague, unexplained form of heart ‘disease’ (the word disease is only used at the end of the story) which could be an emotional, or psychosomatic reaction to Mrs Millard’s day to day life ‘under the thumb’ of her husband. One must remember the story was written in the 19th century, well before the feminist movement and a substantial degree of equality achieved over the subsequent years by women. We, therefore, unconsciously try to confirm our expectations when we communicate with strangers. Our stereotypes constrain strangers’ patterns of communication and engender stereotype-confirming communication. In other words, stereotypes create self-fulfilling prophecies. We tend to see behavior that confirms our expectations even when it is absent. We ignore disconfirming evidence when communicating on automatic pilot. When we communicate on automatic pilot, we do not cognitively process all the information about others that is available to us (Johnston Macrae, 1994). Generally, the greater our cultural and linguistic knowledge, and the more our beliefs overlap with those of the strangers with whom we communicate, the less the likelihood there will be misunderstandings. To increase our accuracy in making prediction, we must try to understand which social identity is guiding strangers’ behavior in a particular situation. And to be effective in communication with strangers, we must keep our minds open and be mindful. Since stereotypes are a natural product of the communication process, they influence the way we process information. Stereotyping is the result of our tendency to overestimate the degree of association between group membership and psychological attributes. While there may be some association between group membership and psychological characteristics of members, it is much smaller than we assume when we communicate on automatic pilot. When we communicate on automatic pilot, we interpret incoming messages on the basis of the symbolic systems we learned as children. Besides, our processing of information is biased in the direction of maintaining the preexisting belief systems. We remember more favorable information about our ingroups and more unfavorable information about outgroups (Hewstone Giles, 1986). So we tend to process information that is consistent with our stereotypes and our stereotypes

Education is a vital part of society in which everyone plays a role. It is not only the role of parents and teachers to support a child’s education, but also the role of the whole society to provide a structure of living that supports what is being taught. The purpose of education is to provide a way for others to learn. However, the motive of learning can vary. Some people may learn out of pure interest, whereas others may learn to be able to function in society by getting a job. Education can occur in any environment where there is a will to learn. Furthermore, learning is not dependent on a teacher or any institute but can also occur as self-learning. The best teaching methods are always those that are chosen by the student, not the teacher. Many students prefer learning methods in which they can apply their knowledge practically. Students learn effectively through hands-on experience. Apart from this, any exposure that can be provided to students of their area of study also helps the student learn their role and their future job within the society. Such exposure can be provided through field trips or inviting professionals related to the students’ field of study to address the students. Support can also be provided to studen ts through alumni groups and career counselors. In this way, the purpose of education and method of education depends largely on the learner or student, not the teacher or institute. There are two main roles that schools play. The first role is towards their students. This is the relationship that the school maintains with its students. The other role is towards society. This includes the school’s participation in public activities such as fund-raising, organizing public events, or participation in any public demonstrations. The role of schools towards society also includes how schools prepare their students to be better members of the society. We must realize here that the latter role of schools, namely that of allowing its students to be better members of society, is not the sole responsibility of the schools. It is true that we usually look upon the teacher and other school officials as the educational leader, role model, and decision-maker towards a child’s education. This is an unfortunate fact because teachers can never teach everything to students. Unfortunately, parents often use educational institutes as a way of neglecting their child. Many parents may show love and support for their child by admitting them to an expensive school. However, this has a negative effect when parents think that they can pay others to keep their child happy and educate them properly. Parents and society as a whole must take responsibility by helping students towards being better human beings. Communication and the ability to speak freely are also involved in this area. Teachers, parents and students must be willing to communicate with each other and discuss ways to improve the level of education. The learning community is not just restricted to students, teachers, and school authorities. The student must never feel intimidated of approaching others and speaking freely, whether it is to a teacher, parent, or anyone else they may encounter in their everyday life. The school curriculum should firstly include that material which will be most useful to the student. If the curriculum deviates from what the student wants to learn then the student will quickly lose interest. In general education, the curriculum should be as vast as possible to allow students to learn about different subjects. In contrast, any curriculum of a specific subject or catering to a specific profession such as art, science or business should be more focused and practical in terms of helping the student later in their career. However, all curricula should also provide a basic level of education such as English and other life skills subjects that will help the student function more effectively within society. Learning should occur in an environment that is healthy not just physically but also mentally and socially. Physical conditions do play a role towards how well the students learn. When teaching a large group of students the room must be well ventilated and be large enough to accommodate the students comfortably. These types of situations normally arise during school lectures or assemblies. However, it is absolutely crucial that every student also receives some individual attention. This can be done either by making the classes smaller so there are less students per teacher or arranging a schedule in which each student is allowed to have individual meetings with the teacher. It is the purpose of teachers and institutes to teach relevant material effectively. Everyone learns differently for different reasons. To teach successfully, teachers must first learn about their students. The contemporary American family is one that shows a picture perfect lifestyle of happiness and normalcy, but this normalcy can be challenged by anything. The present war our country is engaged in is one factor that has changed the lives of many families since it began. Husbands, sons, and sometimes even mothers and daughters are leaving their homes to fight in the war with Iraq. If the traditional American family consists of a husband, wife, and two or more children living in suburbia, my family could once have easily represented it. However, when our country went to war, my dad’s military-career transferred him thousand’s of miles across the ocean disrupting almost every aspect of our once, near perfect household. Most of my life I have had a very comfortable, no worries lifestyle. I was raised by both my parents in a nice home just outside of a pretty big city; we lived there almost eleven years of my life until we moved to a bigger home in a different side of town. My mom became pregnant after we moved into our new house and we soon celebrated the arrival of my sister. After my sister was born our family seemed to change in some ways. I noticed my parents were becoming more involved with both of our schools and doing more parental things. Both of my parents really settled down what little wild youthfulness was still left inside of them; our family was becoming very contemporary and more of the picturesque family most view as normal. My mom didn’t work, but rather stayed home and did the housewife thing while raising my sister and I. My dad has a job in the military, which often times calls him to placed around the country for a few days at a time but never for long. I remember the day I found out my dad had to leave for Iraq. It struck me with different emotions. I was sad for my dad and our family, but I was also shocked because I had never thought this was going to happen to me, to my family. My mom did not take it well. She was very upset because my dad was going to have to leave. Although we knew that my dad, being in the position he is in, would probably avoid much combat, we were still scared, angry and confused as to why this was happening to us. We understood that our country needed my dad, but at that moment it was hard to find much patriotism. We had a few weeks left before my dad left. We didn’t know when he was coming back or what all he w... ...e able to come home. It was an unexpected but wonderful surprise. When my dad returned things almost immediately went back to the way they were when he was around, which was good, but at the same time my mom was doing things that she had really never done before. This change in my mom continued even when my dad was back. He had some trouble at first adjusting to my mom’s new career, but everything worked out okay. The experience I had with my dad leaving is one that many families face. Not every family is as lucky, being so that their father leaves the family to go fight in a war or for some other reason, most are just deadbeats and leave for their own personal reasons. My dad leaving at first turned our family upside down, throwing what we had always known into something totally different, but as time wore on we came to realize that things would be okay. We grew to accept that this experience was difficult, but out of it came positive things. My dad’s leaving challenged my mom’s role as a simple housewife, which then challenged my mom to take over our household. She raised us alone, got a job, and found more self-confidence within herself. My family’s change did a lot of good.

Jem and Scout, his children, encounter many growing experiences throughout their childhood. Dill, Jem and Scout’s friend, visits his Aunt Rachel during the summer. He too encounters growing experiences along with Jem and Scout. These four characters lives are prime examples of the trials of life.   Ã‚  Ã‚  Ã‚  Ã‚  Throughout the novel To Kill a Mockingbird, Atticus teaches many lessons about people, society, and life, especially to Jem and Scout. In Chapter 11, Atticus says to Jem, â€Å"...I wanted you to see what real courage is, instead of getting the idea that courage is a man with a gun in his hand. It’s when you know you’re licked before you begin but you begin anyway and you see it through no matter what...† Atticus tells Jem this after Mrs. Dubose, their neighbor, dies. By saying this, Atticus is teaching Jem that courage comes from within oneself and takes mental strength and maturity.   Ã‚  Ã‚  Ã‚  Ã‚  Atticus teaches Scout to fight with her head instead of her fists in Chapter 9, p. 80 when he says, â€Å"...you just hold your head high and keep those fists down. No matter what anybody says to you, don’t let them get your goat. Try fighting with your head for a change...it’s a good one, even if it does resist learning.† Atticus teaches this concept using himself as an example. She shows immaturity by making fun of her guest, which is something that is normally done by people who don’t know better, or are too young. Scout shows signs of immaturity similar to this throughout the book. It is not until the middle and latter parts of the novel that Jean Louise starts to show signs of growing up and maturing.

Gender Differences in Educational Achievement Essay

Using material from Item A and elsewhere, assess the claim that gender differences in educational achievement are primarily the ‘result of changes in society’ Some sociologists claim that gender differences in achievement are the result of external factors such as changes in wider society, e.g. The impact of feminist ideas and changing employment opportunities (as stated in Item A). However, this could also be an outcome of internal factors such as the education system becoming ‘feminised’, which could have impacted the performance of girls achievement, as it has risen at a faster rate at some levels and in some subjects. Some sociologists also argue that the media have exaggerated the extent and nature of any problem. External factors such as the impact of feminism and girls’ changing ambitions could have a large influence on gender differences in educational achievement. Since the 1960’s, feminism has challenged the traditional stereotypes of a woman’s role as mother and housewife within a patriarchal family. Feminism has also raises girls’ expectations and ambitions with regard to careers and family. These changes are partly reflected in media images and messages. A good illustration of this is McRobbie’s comparison of girls magazine in the 1970’s, where they stressed the importance of marriage to the 1990’s, where it was more focused on career and independence. Changes in the family and employment are also producing changes in girls’ ambitions. This is supported by Sue Sharpe’s research where she compared the results of interviews she carried out with girls in the 1970’s and girls in the 1990’s. In the 1970’s the girls had low aspirations and gave their priorities as love, marriage, husbands and children before careers. However, in the 1990’s girls were more likely to see their future as independent women with a career, rather than being dependent on a husband and his income. There have been a number of major changed to the family in the last 30 years. Some of these include an increase in the divorce rate, cohabitation and an increase in the number of lone parent families (mainly female headed). These changes are affecting girls’ attitudes towards education in a number of ways as increased numbers of female-headed lone-parent families may mean more women need to take on the major ‘bread winner’ role. This further creates a new financially independent, career-minded role model for girls. The need for good qualifications is made very clear and the girls aspirations tend to require academic effort. Becky Francis points out that boys are more likely to have career aspirations that are not only unrealistic but often require few formal qualifications, e.g. professional footballer. Evidence suggests that girls are more likely to spend their leisure time in ways which compliment their education and contribute to educational achievements. Mitsos and Browne place considerable emphasis on reading. Women are more likely to read than men, and mothers are more likely than fathers to read to their children. Therefore girls are more likely to have same-sex role models to encourage them to read. Poor language and literacy skills are likely to affect boys’ performance across a wide range of subjects. Whilst there are factors outside school, internal factors also impact gender differences in educational achievements hugely. According to Tony Sewell, boys fall behind in education because schools have become more ‘feminised’, as indicated in Item A. This means that feminine traits such as methodical working and attentiveness have been emphasised, which in result disadvantaged boys. The gender gap in achievement increased after the introduction of GCSEs and coursework in 1988. Mitsos and Browne argue that girls are more successful in coursework because they are better organised and more conscientious than boys. They found that girls tend to spend more time on their work, take more care on its presentation and are better at keeping deadlines. This all helps girls to benefit from the introduction of coursework in GCSE, AS and A Level. Sewell suggests that some of the coursework should be replaced with final exams and a greater emphasis should be put on outdoor adventure in the curriculum, as he thinks boys learn differently to girls. Jo Boaler argues that equal opportunities policies such as GIST and WISE are a key factor in the improvement of girls educational performance. Schools have become more meritocratic, which means that girls in general work harder than boys and achieve more. Teacher-pupil interactions were also identified as being very significant by Barber. For girls, feedback from teachers focused more on their work rather than their behaviour; for the boys it was the opposite. The low expectations of girls in science reinforced their own self-images; boys frequently overestimated their abilities. Research by Abraham (1995) suggests that teachers perceive boys as being more badly behaved than girls in the classroom, and as such expect bad behaviour. Teachers may also tend to be less strict with boys, giving them more leeway with deadlines and expecting a lower standard of work than they get of girls. This can allow boys to underachieve by failing to push them to achieve their potential. Some sociologists argue that the growth of ‘laddish’ subcultures has contributed to boys’ underachievement. Mac and Ghaill examines the relationship between schooling, work, masculinity and sexuality. He identifies a particular pupil subculture, the ‘macho lads’ which could help to explain why some boys underachieve in education. Jackson found that laddish behaviour was based on the idea that it is uncool to work hard at school. She found that boys based their laddish behaviour on the dominant view of masculinity – they acted tough, messed around, disrupted lessons and saw school work as feminine. Weiner, Arnot and David’s (1997) criticise this theory and have their own theory that the media have created a misleading moral panic which exaggerated and distorts the extent and nature of any problem. They argue that although the media are also interested in the underachievement of white, middle-class boys, they see black and working-class underachievement as a particular problem because it is likely to lead to unqualified, unemployable black and working-class men turning to crime. In conclusion, girls are improving in achievement whereas boys are underachieving due to external factors such as: the impacts of feminism; boys poorer literacy skills, unrealistic expectations and also girls changing ambitions and perceptions. On the other hand, there are also internal factors , which in my opinion are equally as valid and important, such as: laddish subculture, teacher interaction and attention, and also positive role models in schools. However the pre occupation with failing boys diverts attention from underachieving girls. Research by Plummer suggests that a high proportion of working class girls are failing in the school system. Cohen (1999) argues that the question is not ‘why are boys underachieving’, but ‘why boys’ underachievement has now become of concern. Her answer is that it is not just the destruction of the industrial bas of Britain; nor is it the result of pressure put on men by feminism, or by girls’ superior achievement in recent years.

Nevertheless, as the value of gemstones inflated, large scale mining operations have been initiated. Colored and diamond gemstones are subcategories of gemstones. Basically, colored gemstones are all other stones except diamond such as amber, coral and shell (Olson 32.1).On the other hand, natural gemstones are minerals, stones or any organic matter that can be cut, polished, or treated for use as jewelry or other personal ornament (Gemstones Terms, USGS). Gemstones can be further classified as precious or semiprecious gemstones. Precious gemstones have beauty, durability and rarity, while semiprecious gemstones have only one to two of these characteristics (Gemstones Terms, USGS). Diamond, ruby, sapphire, emerald, aquamarine, topaz and opal are classified as precious gemstones while others are treated as semiprecious (Gemstones Terms, USGS). Since gemstones are rare, they are not plentiful and these stones do not form ores like other mining products. They tend to be scattered throughout a large body of rock or can be crystals found on small cavities of rocks (Gemstones Environment, USGS).Gemstones are primarily found from Tennessee, Alabama, Arkansas, North Carolina, Oregon and Arizona (Gemstones Specialist 64). However, most gem diamond reserves are not found in the United States. Diamonds are usually mined from Southern Africa, Russia, and Western Australia (Gemstones Specialist 65). On the other hand, near-gem quality represents diamonds that fall between gem and industrial quality and thus can be used for either purpose.   Clarity of this set is from visible inclusions to industrial. Lastly, industrial quality diamonds are of low quality and cannot be used as jewelry or adornment. These diamonds are suitable only for industrial use such as dentist’s drills and earthmoving equipment (Mining Diamonds).Diamonds are formed beneath the earth’s surface and required tremendous pressure and temperature. Like agriculture, it is one of humankind’s earliest endeavors (Introduction to Mining 1). In 3400, Egyptians in Sinai did the first ever-recorded mining where they have found turquoise (Introduction to Mining 7). Usually, gemstones are excavated at the surface. However, through the years, underground mining especially for diamonds have been developed. Unlike surface mining, underground mining is more complicated and expensive. It involves the efficiency, safety and permanence underground (Introduction to Mining 11).Mining is the process of obtaining useful minerals from the earth’s crust. Its process requires excavations in underground mines and surface excavations in open pit or open cut mines. Thus, it involves physical removal of rock and earth to acquire gems and other important minerals. (Microsoft Encarta). Mining consists of four stages. These stages are prospecting or search for mineral deposits, exploration or the work included in evaluating the extent of economic value of the deposit, innovation or the work of preparing access to the deposit so that the minerals can be extorted from it and exploitation which is the process of extracting the minerals (Microsoft Encarta).Methods of MiningThere are several methods of mining. For gemstones, they are usually obtained on rivers and shores. However, there are also other ways of obtaining them in large scale mining operations. Exploitation methods can be classified into two categories based on setting which are surface and underground mining. Surface mining operations consists of mechanical excavation techniques such as open pit and open cast or strip mining. T here are also aqueous methods such as placer mining and solution mining. On the other hand, underground mining is usually categorized into unsupported, supported and caving methods (Introduction to Mining 11).Placer mining involves excavating loose or alluvial such as sand and gravel. The sought after gems are separated from the sand or gravel by a series of screens, jigs and sluices. This type of mining is usually used for diamonds and rubies (Microsoft Encarta). At present, surface mining involves production of blastholes 3-15 inches in diameter by rotary or percussion drills for the placement of explosives in order to remove consolidated rock. The explosives are then inserted and detonated. The material then is loaded and hauled for transport (Introduction to Mining 15).Diamond MiningDiamonds are mined by pipe or alluvial methods. In pipe mining, extraction of diamonds is done from volcanic pipes. Unlike other gems, diamonds are usually found underground and on volcanic rocks and lands. In diamond pipe mining, large areas are exploited wherein an average of 250 tons of volcanic rock is mined just to produce a one-carat gem quality polished diamond (Mining Diamonds). Due to this intricate and costly process, diamonds are really rare and precious. Diamond pipe mines are composed of kimberlite material called blue ground. At the start, kimberlite is dug from the surface by rough opencast mining. Nevertheless, as the surface deposits are exhausted, pipe mining is employed by sinking shafts into the ground at the edge of pipes and tunnels are driven into the deeper parts of the pipes. By doing so, diamond-bearing rock is excavated and is then transported for screening (Mining Diamonds).Another method of diamond mining is alluvial mining. In this method, diamonds are extracted from riverbeds or ocean beaches. It is true that diamonds are made inside volcanic pipes and lands, however, millions of years allowed that some of the diamonds formed are weathered out of the volcanic pipes and carried to great distances by rivers and oceans. Thus, the process of alluvial mining involves building a wall that holds back the surf. About 25 meters of sand is demolished aside to reach the diamond-containing level in the ocean and riverbeds. After this process, the diamond is almost free from other waste (Mining for Diamonds).Diamonds can then be washed on shaking grease-covered tables. Uncut diamonds then adhere to the grease while the other fragmen ts of waste ore are vibrated past and are discharged to tailings pile. The tables are then scraped for diamonds in the grease and then are boiled to melt the grease and separate the diamonds (Microsoft Encarta). Finally, these diamonds are separated into different grades or quality as industrial, gemstone or near-gem grades.After-Mining OperationsRough uncut diamonds do not actually look attractive. Such diamonds are needed to be cut and polished before anyone can see their beauty and relevance in personal adornment and jewelry. The process of cutting and polishing originated in India where Indian natives discovered a way to make rough diamonds glisten by simply grinding another diamond against it (Mining Diamonds). Diamonds are known for their hardness, no material has ever been found which is capable of cutting diamond until the Indians found out that diamonds could actually be cut and polished by diamonds. The process of cutting and polishing typically lasts for several hours to several months. After which, the diamond will turn out lighter for at least half of its original weight (Mining Diamonds).Diamonds are first carefully examined before cutting. Diamonds are popularly cut into round brilliant since this shape gives the greatest possible brilliance with the minimal weight loss. Cutting uses an instrument similar to grinders. This cutting instrument is made of a paper-thin metal disc coated with diamond dust revolving at a fast speed. Lasers can also cut diamonds nowadays. The corners of the diamonds are then rounded by grinding another diamond producing some dust that can later be used in polishing. Diamonds are then polished to make them sparkle brighter. The diamond dust from the cutting is placed on a turntable made of iron and oiled. The cut diamond is then grinded against the turntable until it sparkles beautifully (Mining Diamonds).ConclusionGemstones are treasures not only of powerful people but also of mighty and ancient civilizations. Life Must Go On

Life is so challenging! As quoted from the sayings of one of my favorite Poet Emily Dickinson, â€Å"Life is a dream for the wise, a game for the fool, a comedy for the rich and a tragedy for the poor†. It Is so funny to think that in life we seem to encounter the so called cycle. From our day to days venture, we experience things different. We experience new practices, occurrences and new learning that somehow lead us on how we begin the new tomorrow.My dear friends and colleagues at this moment of time, I want you to listen to me for a short while. I want you to listen In my speech on how I strives and gradually step forward towards my desired dream in life. I am already near to where I wanted to be! This is the message that I am very proud to utter in myself. But I know all of these things are still in the hands of the Lord. Who could It think that this person standing to all of you this evening, which become a small boy from yesterday and couldn't speak properly, could now speak to you today like this?And who could it think that this person who become so pessimistic from his yesterdays dream would become persevere and a determiner person today? Nothing, except God! In life we can never Identify the future or the outcome process off person. Indeed! If there are still tomorrow that awaits us always, there will always be chances for us to push through what we've started! Way back when I was still in my childhood days, I could not immediately remove the tragedy in our life which happens in the midst of a happy family.It was the time when my father had passed away. In behalf of my family, we could hardly realize and accept the fact that the life of our beloved father is over. Those things really changed the existence we had and accept the reality that we need to start for a new beginning. Despite of those things which were hard for us to accept what really happened, we still believed that life must go on. We survived from those sorrowful mysteries by beli eving In our self that there is still tomorrow that awaits us in a certain time and that there is always God in our side.That's how life plays around on us; we can never say when we should embark from this place and when we should face challenges. What really needs for us to be ready of Is the fact that any time from now we will depart from this world. Ladies and gentlemen, this is how I surpassed the most remarkable tragic experience in my life. I was not able to be defeated by my fear in my heart that though we do not have now the foundation in our family we were able to step forward in our dreams and goals. My mother who exerts all of her efforts and sacrifices Is our main Inspiration why soul fishing the hindrances and challenges we encounter.Now, It as already 9 years had passed after the incidents happened and it seems that the pain is still in our hearts. My Dream Dinner Party Essay

If you could host a dinner party and invite any four people either living or dead, whom would you invite and what would the five of you discuss together? If I am to invite any four people for a dinner party, it would be my pleasure to have the following present: First of all, I would be happy to dine with the chairman and chief architect of the world wide leader in software services and solutions, Microsoft Corporation. The guy considered to be the richest man on earth, no other than William “Bill” Gates. Another visitor whom I would like to join us would be one of the top businessmen in South Africa, the Chairman of Harmony Gold Mining Company Ltd., Mr. Patrice Motsepe. My third guest passed away last June 25, 1997. He was known for his invention of the underwater camera and underwater TV processes as well as numerous undersea expeditions and TV specials made useful up to the present. I would be glad if he could join us from the world of the unknown Ââ€" Mr. Jacques-Yves Co usteau. And finally my last but definitely not the least visitor would be the 43rd President of the United States, Mr. George Walker Bush. Our discussion would center on modern inventions for the global market and its impacts on the business world. We would specifically deal on Bill GatesÂ’ vision for 2005 Ââ€" the digital lifestyle. First of all, our top businessman Mr. Motsepe will discuss to us the current trend of the world market and the pressing technological needs faced by the business world. We would like to know what sort of difficulties if there are any, are faced by the mining industry, and how technology can play a part in solving these issues. In addition, President Bush will also share to us the present problems faced by his administration and the implications of these in the business community. We also would like the president to tell us his thoughts on the role of technology in decreasing these problems and gearing forward to its solutions. Moreover, we would like to hear suggestions from Mr. Gates on how technology can play a vital role in addressing the problems faced in this era and possible innovations that will be created to improve the quality of business and governance. It is imperative that he would work hand in hand with our representatives from business and from the government to create technological solutions to our issues. Furthermore, I would like Gates to share to us the different innovations from Microsoft that we would expect to  emerge in the year 2005 and the usefulness of these innovations in peopleÂ’s lives particularly in the corporate setting. Here, Mr. Jacques-Yves Cousteau would be helpful to tell us all about his underwater television and how this can be improved by GatesÂ’ digital means. We also would like him to share to us some ideas that could lead to further inventions and technologies that can be used underwater. Finally, the presidentÂ’s presence is very important since we would need his support not only for the spread of the new technological innovations but also for its use in the business world. It would be very fantastic if the government will also benefit from the modern innovations and processes used in the business community.

The Negro Leagues was the third largest black business in this country. Yeah. First, black insurances to white insurances ten cent policy, just enough to bury us. But the black insurances insured our crops, our homes, yeah , our stock. They made millions. Next, Madame C.J. Walker cosmetology. You see that pretty hair over there? Dont you see it on Mrs. Robinson? Tell you what. Yeah. Thats right. Yeah. Yeah. Madame C. J. Walker was doing that a hundred years ago, and she made millions, to tell you the truth. Madame C. J. Walker was the first black woman millionaire in this country. And to tell you Madam C.J. Walker might have been the first woman millionaire in the country that earned it. They had other women millionaires but they inherited the money. Madam C.J. Walker earned it. Next, Negro League baseball. All you needed was a bus, and we rode in some of the best buses money could buy, yeah, a couple of sets of uniforms. You could have 20 of the best athletes that ever lived. And that’s who we are representing here today. It was outstanding. And playing in the Negro leagues what a lot of you don’t know. See, when I played in the Negro leagues I first came to the Negro leagues five percent of Major League ball players were college men because the major leaguers wanted them right out of high school, put them in the minor league, bring them on in. But Negro leagues, 40 percent of Negro leagues, leaguers, were college men. The reason that was, we always spring trained in a black college town and that’s who we played in spring training, the black colleges. So when school was out, they came and played baseball. When baseball season was over, they’d go back to teaching, to coaching, or to classes. That was Negro League baseball. And Im proud to have been a Negro league ball player. Yeah, yeah. And I tell you what, they always said to me Buck, I know you hate people for what they did to you or what they did to your folks. I said, No, man, I I never learned to hate. I hate cancer. Cancer killed my mother. My wife died 10 years ago of cancer. (Im single, ladies.) A good friend of mine I hate AIDS. A good friend of mine died of AIDS three months ago. I hate AIDS. But I can’t hate a human being because my God never made anything ugly. Now, you can be ugly if you wanna, boy, but God didn’t make you that way. Uh, uh. They fundamentally seemed to need to communicate the true horror of what they had experienced during the First World War, possibly to break the romanticized ideas that had been formed in people’s minds based on war propaganda of the time (Tolson 2010). These are two modern pieces of propaganda. The first is an advertisement for M&Ms, which directly place on the propaganda of the past, especially Soviet propaganda. The second, with a distinctly modern, clean type face, is an advertisement for the Kony 2012 group, who accepted large amounts of funds to supposedly help find and arrest Kony, and help his victims. One of the interesting things about both of these pieces of propaganda is that they play on their viewer’s desire for connection.

Revolutions of the people were built upon the support of women, and in women used their dedication during wartime to garner support for peace-time rights. Women in Western Europe tried to harness the spirit of freedom, equality, and popular sovereignty. It was during the era of revolution that large womens rights movements were established, providing women with their own unions. Enlightenment thinkers presented very convincing arguments for female rights, and in many cases persuaded governments to grant women rights such as free public education, inheritance, and legalized divorce. However, little in terms of actual rights were achieved. In China, industrialization had become a part of life following the mid-eighteenth century. Unlike European industrializing power, China industrialized while relatively remote from other industrial nations, allowing it to develop its own strand of industrialization. Before industrialization, the humiliating practice of foot binding was very popular. Girls were often victims of infanticide, as boys could grow up to become government officials whereas girls would be married and become subservient to another family. Population growth in China caused by industrialization led to social change, and social revolution came in the form of the Taiping program, which decreed that men and women were equal. Though quickly put down, this showed that on the small scale, Chinese women were gaining more rights and independence, and a many people believed that they should no longer be treated as subservient individuals. Throughout the era of revolution, women maintained a, to some degree,  subservient position to men. Despite the many attempts by feminists to try and gain equal rights, little besides recognized was gained for the feminist cause. Indeed, it was not until after World War I that women gained suffrage. Up through 1914, women throughout both China and Western Europe maintained the same generally subservient role in the male household, despite gaining several token rights. It required large-scale social change in order to change the ingrown attitude towards women. Overall, working-class women in Western Europe and China gained little between 1750 and 1914 CE. They built the ideas and foundation that they would need in order to gain rights such as suffrage and legal equality later in the twentieth century, but little more than symbolic rights were granted them. Development Of Sentencing Policy In England Law Essay According to Andrew Ashworth (Sentencing and Criminal Justice, 5th Edition, Cambridge University Press (2010), p.77), section 142 of The Criminal Justice Act 2003 appears to embody the worst of pick-and-mix sentencing, and one which invites inconsistency. In the light of this statement discuss, and comment, on the aims and purposes of sentencing. To what extent are they a reflection of sentencing currently practised by courts? This essay seeks to consider the way in which the sentencing policy has developed under English law on the basis of the fact that many academics including Ashworth look upon the current system as being somewhat pick-and-mix illustrated by section 142 of the Criminal Justice Act 2003. With this in mind, this essay looks to produce a discussion that is considered to be able to serve to provide an understanding of the aims of sentencing traditionally and as to how English law has looked to fulfil these aims and the extent to which they have proved successful in this regard. In considering the idea section 142 of The Criminal Justice Act (CJA) 2003 appears to embody the worst of pick-and-mix sentencing (Ashworth, 2010), it is necessary to appreciate how it may invite inconsistency by first discussing the aims of sentencing before looking to expand and focus this discussion upon the specific provision and related provisions. On this basis, it should be possible to then determine the extent to which these aims are a reflection of policies of sentencing currently practised by courts in the UK and their associated aims. Finally, this essay will then look to conclude with a summary of the key points derived from this discussion in relation to the remit of sentencing in the UK and as to how it is currently practised by domestic courts. When considering the different aims of sentencing there are significant rationales involved with the development of an effective policy focussed upon achieving retribution, deterrence, rehabilitation, restorative justice, and incapacitation founded upon a specific offenders culpability that can prove complicated (Tonry, 2005). Nevertheless, such an understanding is ably supported by philosopher, Immanuel Kant (2002) to mark the beginning of modern theories of punishment as he argued the only morally legitimate justification for sentencing. Therefore, the key function of such policy is to look to ensure offenders receive the appropriate sentences to manage the apparent conflict that exists between individual liberty under Article 5 of the European Convention on Human Rights (ECHR) 1950 (domestically implemented by the Human Rights Act (HRA) 1998) and the interests of society as a whole (see, for example, Steel v. United Kingdom). However, it has proved difficult for an effective sente ncing policy to develop that is able to find a balance between the aims that have been recognised to account for goals of crime-prevention and the apportioning of punishment (Fraser, 2005). More specifically, government policy makers have sought to explain away major changes with a view to increasing public confidence (Home Office, 2002, p.13) because the criminal justice system domestically did not have the necessary credibility and legitimacy government policy makers felt was necessary to make punishments and sanctions for criminal activity more effective, certain, and consistent (Tonry, 2005). Sentencing policy in the UK has been largely explained by the fact that, for over a decade, government policy makers have explained away major changes as part of a larger effort to increase public confidence in the English legal system (Home Office, 2002, p.13). Prior to the making of these changes, it had been a traditional social belief this countrys criminal justice system did not have the necessary credibility and legitimacy government policy makers felt was necessary to make criminal punishments more effective, certain, and consistent to address citizens problems (Tonry, 2005). But, despite this clear need and the changes, it is arguable that sentencing has still become something of a pick and mix process aptly illustrated by section 142 of the CJA 2003 regarding the purpose of sentencing policy in the English legal system (Ashworth, 2010). Therefore, both the aims and purpose of the domestic system of sentencing has arguably been lost without set guidelines to follow in the int erests of fairness and consistency regarding the sanctioning of offenders because the current codification of the law is arguably too discretionary for the judiciary to utilise in keeping with the remit of their powers as it relates to making their decisions in any given case. Section 142 of the CJA 2003 recognises criminal courts need to consider the following purposes of sentencing (a) punishment; (b) the reduction of crime; (c) reform and rehabilitation; (d) social protection; and (e) reparation. As a result, unfortunately, it is arguable such a provision was always bound to lead to significant problems because it seems to require the judiciary to actively consider a variety of aims before then giving weight to one factor above all of the rest that they must consider to reach a decision (Ashworth, 2010). But such concerns regarding sentencing serve to detract from its aims that now arguably lack foundation since the Sentencing Guidelines Council has adopted section 143 as opposed to section 142 of the CJA 2003 to determine appropriate sanctions for criminal offenders (Tonry, 2005). Section 143 specifically provides, for the purpose of sentencing, the court must consider the offenders culpability in committing the offence and any harm which the offenc e caused, was intended to cause or might foreseeably have cause. Therefore, it has been for the Sentencing Guidelines Council to focus its attention upon the proportionality principle to determine what is required for the sentencing of individual criminal offences to be more effective (Von Hirsch Roberts, 2004). However, the policy of sentencing under English law still remains sufficiently uncertain so one is left to wonder what will happen if section 142 of the CJA 2003 is favoured when determining how the Sentencing Guidelines Councils Overarching Principles Seriousness (2004) is to be followed by the courts in deciding sanctions in any given case. This is because it has proved arguable that section 142 under the CJA 2003 has already given the judiciary too greater autonomy in deciding the sentencing of offenders in any given case regarding the appropriate sanction for the offence the defendant has committed where they are found guilty (Rex Tonry, 2005, Chapter 5). As a result, doubts have arisen throughout society about whether changes in sentencing would actually reduce crime when many people have sought tougher penalties to reduce crime rates through a system that expounded the virtues of deterrence and incapacitation to achieve the aforementioned aims of sentencing. At the same time, however, there is a need to appreciate the prospect for effective rehabilitation from the sentence that an offender is given has changed quite radically under contemporary law. This is because effectively targeted programs, as part of an offenders sentence, can serve to limit the probability of that individual then re-offending through the drug treatment, anger management, sex-offender treatment, and various educational and vocational-skills programs implemented to prevent further offences occurring in the interests of crime prevention within society (Gaes, 1999). By way of illustration, the Home Offices Halliday Report provided the foundation for a massive reorganisation of the English criminal justice system under the CJA 2003 so it was concluded if the [treatment] programmes are developed and applied as intended, to the maximum extent possible, reconviction rates might be reduced by 5-25 percentage points. (Halliday, et al, 2001, p.7) Therefore, a new approach to custodial sentences was proposed and endorsed totalling less than a year with three specific options available. The first is custody plus consisting of a maximum of 13 weeks in prison with the rest being made up by community service, whilst sentencing may also consist of a policy of intermittent custody that involves weekend imprisonment for up 51 weeks (sections 183-186 at CJA 2003). Finally, there is also the possibility of custody minus whereby the offenders sentence is suspended for a maximum of 51 weeks with community service carried out instead (Von Hisch Roberts, 2004). On this basis, the methods for dealing with minor criminal matters have taken on greater significance with the CJA 2003s enactment, since sections 22-27 now also supplement the existing system of cautions (under the Police Criminal Evidence Act 1984) with conditional cautions which may be given when the conditions set out are fulfilled (Ashworth Redmayne, 2005, Chapter 6). However, whilst the CJA 2003 has introduced a new mandatory minimum sentence of five years for possession of firearms without a licence under section 287, there has been a distinct lack of Court of Appeal guidance for the minimum sentence for domestic burglary (section 111 at Power of Criminal Courts (Sentencing) Act 2000) but was not endorsed by the Court of Appeal (R v. Hoare) unlike, for example, guidelines on rape (R v. Milberry). Moreover, the CJA 2003 also eliminated the automatic life imprisonment sentence and absorbed it within the new dangerousness sentences (sections 224-236 Schedules 15 18 of the CJA 2003 because decisions like Stafford v. UK recognised the Home Secretarys power to set a minimum time for someone to remain in prison who is imprisoned for life (see also section 269 Schedule 21 of the CJA 2003). As for the matter of previous convictions impact upon sentencing individual offenders, where an individual has already been convicted of another offence they should be liable to a much stricter penalty for all offences they are convicted of thereafter because such convictions are illustrative of an individuals bad character in court proceedings to impact upon a given case (Choo, 2006, Chapter 8). However, the CJA 2003 have proved somewhat controversial to say the least because the precise moment of their coming into force has proved a matter of notable dispute (R v. Bradley) as well as the fact that, in a criminal trial, any evidence relevant to the case should be admissible (Rees Roberts, 2006). This proved necessary because it was previously largely understood under section 1(3) of the Criminal Evidence Act 1898 the prosecution in any criminal case was unable to adduce evidence of a defendants bad character except regarding the offence a defendant was charged with unless it was co nsidered probative to the best interests of justice (Durston, 2004). But what Lord Wilberforce said in Boardman v. Director of Public Prosecutions (p.444) acted as a caveat in recognising the admission of similar fact evidence (of the kind now in question) is exceptional and requires a strong degree of probative force to be admissible prior to the CJA 2003. Therefore, the level of sentencing may then be determined fairly and consistently in keeping with the facts of any given case to provide sufficient sanctions in the best interests of justice for society as a whole (Fitzpatrick, 2006). In addition, the exclusionary rule previously emphasised as being of fundamental significance against the admission of previous misconduct and other evidence of bad character has now been largely abolished where it is found the matters to be considered are relevant to the issues at hand (section 101 of the CJA 2003). By way of illustration, under section 103(1) of the CJA 2003, the matters in issue between the defendant and the prosecution include: (a) The question whether the defendant has a propensity to commit offences of the kind with which he is charged, except where his having such a propensity makes it no more likely that he is guilty of the offence (Roberts, 2006). But whilst there is little doubt those who drafted this provision intended to make evidence of a defendants bad character admissible because it shows they have a general tendency to commit offences, there is room for considerable doubt about whether the provision achieves its aim (Withey, 2007). To conclude, policy makers under English law have sought to develop a system of sentencing that fulfils its recognised aims since the CJA 2003 has sought to provide for the achievement of higher levels of fairness in the decisions reached to prevent further instances of crime and act in societys best interests. This is because not only can an effective system of sentencing provide a deterrent for others in society, but this can also serve as a means of punishment and rehabilitation. However, whilst the CJA 2003s remit has been called into question because it would seem to give too wider discretion to the judiciary in looking to reason out their decisions, previous convictions must also now be taken into account in determining the level of sentencing for any individual found guilty of a criminal offence as an indication of bad character under the CJA 2003. But, to achieve a consistent and fair approach to the administration of justice through an effective sentencing policy, it is stil l necessary to adhere to the Act to come to a fair approach to sentencing and sanctions to punish and rehabilitate a guilty offender whilst also deterring others from carrying out similar offences.
